Welcome to Momentum Lawn Care & Services. These Terms of Service ("Terms") govern your use of our website at join.momentumlawncare.com, and momentumlawncare.com (collectively, the "Site") and our lawn care services (the "Services").
By using our Site, creating an account, or requesting services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.
1. Services Provided
1.1 Lawn Care Services
Momentum Lawn Care & Services provides professional lawn maintenance and care services in Zephyrhills, Florida and surrounding areas, including but not limited to:
- Regular lawn mowing and edging
- Lawn fertilization and weed control
- Hedge trimming and landscaping
- Seasonal cleanup services
- Other lawn care services as agreed upon
1.2 Service Area
We provide services in the following ZIP codes in the Zephyrhills area:
- 33543, 33544, 33545 (Zephyrhills)
- 33539, 33540, 33541, 33542 (surrounding areas)
- 33647 (extended service area)
Service availability is subject to geographic location and our capacity. We reserve the right to decline service requests outside our service area or if we are at capacity.
2. Account Creation and Customer Portal
2.1 Automatic Account Creation
When you enter your information on our landing page (join.momentumlawncare.com) and click "Continue," your customer account is automatically created. By completing this action, you agree to these Terms.
Your account provides access to a customer portal where you can:
- View service history and upcoming appointments
- Manage payment methods
- Update contact information and preferences
- View invoices and receipts
2.2 Customer Portal Access
After successfully completing checkout and saving a payment method, you will receive a welcome email containing:
- Your unique customer portal link
- Login credentials (if applicable)
- Service confirmation and next steps
You are responsible for:
- Providing accurate and complete information
- Maintaining the security of your portal access
- Keeping your contact information up to date
- Notifying us immediately of any unauthorized access
2.3 Account Eligibility
You must be at least 18 years old to create an account and use our Services. You must have authority to enter into this agreement and request services for the property address provided.
3. Service Scheduling and Pricing
3.1 Service Setup
When you request services through our Site:
- You select your property size (Small, Medium, or Large)
- You choose your service frequency (Weekly or Bi-Weekly)
- Pricing is displayed upfront based on your selections
- You save a payment method on file for recurring charges
- Services begin after you complete checkout and your account is created
3.2 Pricing Structure
Service pricing is based on:
- Property Size: Small (up to 5,000 sq ft), Medium (5,001-10,000 sq ft), Large (10,001+ sq ft)
- Service Frequency: Weekly or bi-weekly visits
- Property Conditions: Additional charges may apply for special circumstances (see Section 3.3)
All prices are displayed on our Site before checkout. Prices are in USD and subject to change as described in Section 3.3.
3.3 Price Adjustments
Important Price Change Policy:
For recurring services, we will provide 7 days' advance notice of standard price increases via email or SMS.
IMMEDIATE price adjustments (without prior notice) may apply if our crew discovers:
- Overgrown grass or excessive vegetation
- Numerous obstacles (toys, equipment, debris)
- Hilly or difficult terrain not previously disclosed
- Pet waste requiring cleanup
- Other conditions requiring significantly more time or resources
In these cases, you will be notified immediately via SMS or verbal communication over the phone, and the adjusted price will apply to that service visit.
Continued use of services after a price change constitutes acceptance of the new pricing.
4. Payment Terms
4.1 Payment Method
Payment is processed securely through Stripe, a PCI-DSS compliant payment processor. We accept major credit cards and debit cards.
By providing your payment method, you authorize us to:
- Store your payment method on file
- Charge your payment method immediately after each service is completed
- Automatically charge for recurring services according to your selected frequency
4.2 Payment Timing
⚠️ Important Payment Policy:
Your card will be charged IMMEDIATELY after completion of each service visit.
Charges are typically processed within minutes to hours of service completion. You will receive a receipt via email.
4.3 Failed Payments and Late Fees
If a payment fails or is declined:
- Immediate Action: We will attempt to process payment again
- Service Suspension: Your services will be paused immediately until the outstanding invoice is paid in full
- Late Fee: On the 3rd day after a failed payment, a $15 late fee will be applied to your invoice
- Collections: Continued non-payment may result in account termination and collection efforts
To resume services, you must:
- Pay the outstanding invoice in full (including any late fees)
- Update your payment method to a valid card
- Contact us to reschedule service
4.4 Refunds and Service Guarantees
We strive for 100% customer satisfaction. If you are unsatisfied with a service:
- Contact us within 48 hours of the service visit
- We will schedule a re-service at no additional charge, or
- Issue a refund at our discretion
Refunds (if issued) are typically processed within 5-7 business days to the original payment method.
5. Service Cancellation and Changes
5.1 Customer Cancellation
You may cancel your recurring services at any time by contacting us:

Provide at least 24 hours' notice before your next scheduled visit to avoid being charged.
No cancellation fees. You will only be charged for services already rendered.
5.2 Skip or Reschedule Visits
To skip or reschedule a single visit:
- Provide at least 24 hours' notice
- Contact us via email or text/SMS
- Rescheduling is subject to availability
5.3 Service Suspension or Termination by Company
We reserve the right to suspend or terminate services, with or without cause, at any time for any reason, including but not limited to:
- Non-payment or past-due invoices
- Violation of these Terms
- Unsafe or hazardous conditions on your property
- Abusive, threatening, or inappropriate behavior toward our staff
- Property access issues or security concerns
- Capacity constraints or operational reasons
- Any other reason we deem necessary in our sole discretion
If we suspend or terminate your services, you will be notified via email or SMS. You will only be charged for services rendered up to the suspension/termination date.
6. Communication Preferences
6.1 Primary Communication Methods
All communication with Momentum Lawn Care & Services is conducted via text/SMS or email.
You will receive communications via:
- Email: Service confirmations, receipts, customer portal links, important updates
- SMS/Text: Service reminders, schedule changes, price adjustments, payment notifications

6.2 Consent to Electronic Communications
By using our Services, you consent to receive:
- Transactional Communications: Service confirmations, receipts, portal access, schedule changes (required)
- SMS Notifications: Service reminders, updates, price changes (with opt-in)
- Marketing Communications: Promotional offers, seasonal services (with opt-in)
You may opt out of marketing communications at any time by replying STOP to SMS messages or clicking "unsubscribe" in emails. You cannot opt out of transactional/service-related communications while you have active services.
7. Property Access and Preparation
7.1 Access to Property
By scheduling services, you grant us permission to access your property to perform the requested lawn care services. You agree to:
- Ensure safe and unobstructed access to all service areas
- Remove obstacles (toys, hoses, decorations, furniture) before service
- Secure or remove pets from the service area during our visit
- Notify us in advance of any hazards (sprinkler heads, underground utilities, unmarked cables, etc.)
- Ensure gates are unlocked or provide access codes if applicable
7.2 Property Damage and Liability
We take great care in performing our services. However:
- We are not responsible for damage to items left in the service area (hoses, decorations, toys, etc.)
- We are not responsible for pre-existing hidden hazards (underground utilities, unmarked sprinklers, buried cables)
- Any damage caused by our negligence will be repaired or compensated at our discretion

8. Use of Photos and Videos for Marketing
By using our Services, you grant Momentum Lawn Care & Services the right to:
- Take photos and videos of your property before, during, and after service
- Use before/after photos and progression videos for marketing and promotional purposes
- Post images and videos on our website, social media, advertising, and marketing materials
- Use your property address general area (e.g., "Zephyrhills neighborhood") in marketing (not full address)
This license is perpetual, worldwide, royalty-free, and non-exclusive. You retain ownership of your property, but grant us unlimited rights to use photos/videos we create.
If you do NOT consent to this, you must notify us in writing at [email protected] before your first service.
9. Service Interruptions and Force Majeure
9.1 Weather and Uncontrollable Events
Services may be delayed or rescheduled due to:
- Severe weather (heavy rain, storms, lightning, extreme heat)
- Acts of God (hurricanes, flooding, tornadoes, natural disasters)
- Equipment failure or vehicle breakdown
- Illness or unavailability of crew
- Government restrictions or mandates
- Other circumstances beyond our reasonable control
We will make reasonable efforts to reschedule missed visits. You will not be charged for services not performed.
10. Intellectual Property
10.1 Our Content
All content on our Site (text, images, logos, graphics, videos, design) is owned by Momentum Lawn Care & Services and protected by copyright, trademark, and other intellectual property laws.
You may not:
- Copy, reproduce, or distribute our content without written permission
- Use our trademarks, logos, or branding without authorization
- Modify or create derivative works from our content
- Use our Site content for commercial purposes
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY FLORIDA LAW:
- Momentum Lawn Care & Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services
- Our total liability for any claim shall not exceed the amount you paid for services in the 3 months preceding the claim
- We do not guarantee specific results or outcomes from our lawn care services (healthy grass, weed elimination, etc.)
- We are not responsible for damage caused by factors beyond our control (weather, pests, disease, soil conditions, lawn health, etc.)
- We are not liable for delays or service interruptions due to force majeure events
Some states do not allow limitations on certain warranties or damages, so some limitations may not apply to you. You may have additional rights under Florida law.
12. Indemnification
You agree to indemnify, defend, and hold harmless Momentum Lawn Care & Services, its owners, officers, employees, contractors, and agents from any claims, damages, losses, or expenses (including attorney's fees) arising from:
- Your violation of these Terms
- Your use of our Services
- Hazards or unsafe conditions on your property that you failed to disclose
- Injury to persons or damage to property resulting from your failure to follow instructions
- Violation of any third-party rights
- Any false or misleading information you provide
13. Dispute Resolution and Governing Law
13.1 Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Pasco County, Florida.
13.2 Informal Resolution First
If you have a dispute, please contact us first at [email protected] or (813) 252-1023. We will attempt to resolve the issue informally within 30 days.
13.3 Arbitration Agreement
If we cannot resolve a dispute informally, you agree that any dispute shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association in Pasco County, Florida, rather than in court.
BY AGREEING TO THESE TERMS, YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION LAWSUIT.
This arbitration agreement does not prevent you from bringing issues to the attention of federal, state, or local agencies or filing a complaint with consumer protection authorities.
13.4 Small Claims Court Exception
Either party may bring a claim in small claims court instead of arbitration if the claim qualifies under Florida small claims court rules.
14. Warranty Disclaimer
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability or fitness for a particular purpose
- Warranties that services will be uninterrupted, timely, or error-free
- Warranties regarding the results or outcomes of services (lawn health, appearance, weed elimination)
- Warranties that services will meet your specific expectations
We make no guarantees about lawn health, grass growth, weed control, or aesthetic outcomes, as these are affected by many factors beyond our control (weather, soil, pests, disease, etc.).
15. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court, the remaining provisions will remain in full force and effect.
16. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated by:
- Posting the updated Terms on this page with a new "Last Updated" date
- Sending an email or SMS notification to your registered contact information
Continued use of our Services after changes constitutes acceptance of the updated Terms. If you do not agree to the changes, you must cancel your services.

18. Entire Agreement

You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign these Terms to any successor or affiliate at our discretion.
